Terms of Service
The agreement between you and this marketplace, written so a rider can actually follow it. The short version sits at the top; the detail runs underneath.
These terms govern your use of Best Limos of Myrtle Beach, a blind bid marketplace where riders post a trip and licensed South Carolina transportation companies submit private competing bids on it. They apply to everyone who uses this website, whether you post a trip, accept a bid, submit a message through the contact form, or simply read a page.
Most terms of service documents are written to be skipped. This one is written to be read, because the single most important thing on it is a fact people routinely get wrong: we run the marketplace, we do not drive the vehicle. Understanding where our responsibility stops and the operator's begins saves everybody a difficult conversation later.
The Short Version
1. Accepting These Terms
By using this site you agree to these terms. If you do not agree with them, the appropriate response is to stop using the marketplace, which costs nothing to post because there is no account to close and no subscription to cancel. If you are posting a trip for a company, a school, a club or anyone other than yourself, you confirm that you are authorized to do so and that you accept these terms on that party's behalf as well as your own.
These terms work alongside our privacy policy, which explains what personal information the site collects and who receives it. Read both. They describe two halves of the same transaction.
2. What This Marketplace Is, and What It Is Not
Best Limos of Myrtle Beach is an intermediary. We publish a website that collects trip details from riders and distributes them to independent transportation companies who choose whether to bid. That is the whole of the service we provide.
We are not a motor carrier, a limousine company, a charter bus operator, a broker of your ride in the sense of dispatching it, or an employer of any chauffeur. We do not own, lease, maintain, inspect, insure or dispatch a single vehicle. Every company that bids on this platform is a separate legal business, responsible for its own licensing, its own insurance, its own drivers, its own equipment and its own conduct.
That distinction has practical consequences and we would rather state them plainly than bury them. We cannot put a car at your door. We cannot make a chauffeur arrive on time. We cannot refund a fare we never collected. What we can do is give you competing offers from vetted companies and a record of what was agreed, which is a good deal more than a phone call to one company gets you. 3. Who May Use the Site
You must be at least eighteen years old to post a trip or accept a bid. Bookings that carry minors, prom and school transportation being the obvious cases, are posted and accepted by a parent, guardian or other responsible adult who takes on these terms for the booking. Operators may refuse to release a vehicle to an unaccompanied minor, and that refusal is theirs to make.
You agree to give accurate information when you post a trip. Passenger counts, timings, luggage and pickup addresses are what operators price against, and a bid based on wrong details is not a bid the operator has to honour.
4. Posting a Trip and Receiving Bids
Posting a trip is free, and it commits you to nothing. It is a request for offers, not an order. Operators view the trip details without seeing your name, email address or phone number, and they submit sealed bids that other bidders cannot see.
Bids are offers from the operator, valid on the terms and for the period that operator states. We do not set, review, approve or negotiate prices, and we do not promise that any particular trip will attract a bid at all. Thin dates, unusual routes, very late notice and very large groups are all situations where a request may draw few offers or none. If nothing comes back, nothing has been lost except the ninety seconds it took to ask.
5. Accepting a Bid Creates a Binding Agreement
This is the moment the legal relationship changes, so it deserves its own section. When you accept a bid, you enter into a transportation agreement with that operator. Not with us. The operator becomes your carrier, you become their customer, and the terms of that bid become the terms of your booking.
At the point of acceptance we release your name, email address and phone number to that one operator so they can confirm the details with you directly. Everything after that, the vehicle, the chauffeur, the timing, the payment, the deposit, the gratuity and any change to the plan, is arranged between the two of you.
6. Operator Vetting and Its Limits
Before a company can submit its first bid, we check that it holds active South Carolina business registration, the passenger carrier authority its vehicle class requires, and commercial livery insurance. We repeat those checks and we remove companies that let them lapse, that misuse rider information, or that accumulate credible complaints.
Vetting is a filter, not a warranty. Confirming that a company is licensed and insured tells you it is entitled to carry passengers; it does not tell you the driver will be early, that the interior will be spotless, or that a vehicle will not break down. We make no representation about the quality, safety, punctuality or suitability of any operator's service, and the checks we run do not make us liable for how a company performs a job we did not perform. If an operator falls short, report it to us. We act on that information, and the operator remains responsible for the service.
Admission to the network is at our sole discretion
Meeting the licensing and insurance requirements makes a company eligible to apply. It does not entitle it to join. We reserve the right to approve or deny any transportation company's application, and to suspend, restrict or permanently remove any operator already in the network, at any time, with or without notice, for any reason or for no reason, in our sole and absolute discretion. We are not required to give a reason for a decision, to give advance warning, or to reconsider a decision we have made.
To be concrete about the kinds of things that inform these decisions, without limiting the discretion described above: lapsed or unverifiable credentials, insurance that falls below the limits a vehicle class requires, misrepresentation on an application, vehicles that do not match the photos submitted with a bid, misuse of rider contact information, attempts to move a booking off the platform to avoid fees, patterns of cancellation or no shows, credible safety complaints, abusive conduct toward riders or staff, or conduct that we judge to be inconsistent with the standard we hold the network to.
Applying does not create a contract, a partnership, an agency relationship or an expectation of acceptance, and nothing in these terms obliges us to distribute any particular volume of bid requests to any operator. Where an operator has paid a success fee on a booking already completed, removal from the network does not affect that completed transaction. This discretion is exercised subject to applicable law, and nothing here permits a decision made on the basis of race, color, religion, sex, national origin, disability, age, or any other characteristic protected by federal or South Carolina law.
Booking Deposits
Posting a trip and comparing bids is free. Money only enters the picture at the moment you accept a bid.
When you accept a bid, a booking deposit is payable to Best Limos of Myrtle Beach. The amount is shown to you before you confirm, and nothing is charged until you complete that step. Paying the deposit confirms the booking, takes the trip off the market so the operator can hold the date, and releases your contact details to the winning company.
The deposit comes off your fare
The deposit is credited against the accepted bid, not charged on top of it. If you accept a bid of five hundred dollars and the deposit is one hundred, you have paid one hundred and you owe the operator four hundred. The total you pay does not change because you booked here. Your confirmation shows all three numbers: the accepted fare, the deposit you paid us, and the balance payable to the operator.
The balance is settled directly with the operator on that company's own terms, which usually means on the day of the trip. Gratuity, waiting time beyond the booked hours, tolls and any extras agreed with the operator are separate from both the deposit and the quoted fare, and are matters between you and the operator.
The deposit is non-refundable
Once a booking is confirmed, the deposit is non-refundable if you cancel, change your mind, reduce the trip, or do not travel. That is the point of it: the operator stops selling that date and turns away other work on the strength of your booking. This applies however far ahead of the trip you cancel.
There are three situations where we do refund in full, because in each of them the failure is not yours:
- The operator cancels or does not perform. If the winning company cancels, fails to arrive, or cannot supply a vehicle reasonably equivalent to the one it bid, you get the deposit back in full.
- We remove the operator before your trip. If a company is suspended or removed from the network between your booking and your travel date, we will either put the trip back out for bids or refund the deposit, whichever you prefer.
- A duplicate or mistaken charge. Refunded in full on request.
If your trip cannot go ahead for reasons outside anyone's control, such as severe weather or a road closure, the operator's own policy governs what happens to the booking and the balance. Many operators will reschedule. Contact us through the contact form if an operator will not honor the terms it published with its bid, and we will look at it.
Deposits are quoted and charged in United States dollars. Payments are processed by a third party payment provider, and we do not receive or store your full card number. Raising a chargeback without first contacting us may result in loss of access to the platform.
7. Prices, Fees and Payment
Riders pay this marketplace nothing. There is no posting fee, no membership, no booking surcharge and no markup applied to a bid. A booking deposit, credited against the fare you accept, is how the platform is funded and is described in ordinary language on the about page.
All fares, deposits, tolls, parking, fuel surcharges, gratuities and taxes are collected by the operator under their own payment terms. We do not process your payment, hold your funds or issue refunds for a trip. A refund request goes to the company you booked, and if that company will not engage with you, tell us, because a pattern of that behaviour is grounds for removal from the network.
8. Cancellations, Changes and No Shows
Cancellation and change terms belong to the operator. Some fleets refund a deposit up to a set number of days out, some hold it, some apply a sliding scale as the date approaches, and peak dates are frequently stricter than quiet ones. There is no single marketplace policy that overrides what you agreed with the company you chose, and we would be misleading you if we pretended otherwise.
You may withdraw a posted trip at any time before you accept a bid, and doing so costs nothing. Once a bid is accepted, cancellation runs through the operator's terms. Changes work the same way: a new pickup time, an extra stop, a bigger group or a different vehicle class is a change to your agreement with the operator, and it may change the price. Get any change confirmed in writing by the company, not by us.

9. Acceptable Use of This Site
Use the marketplace for its purpose: arranging chauffeured transportation. You agree not to do any of the following.
- Post a trip you have no intention of taking, including test requests, competitor price probes and requests posted to waste an operator's time.
- Impersonate anyone or submit a request using another person's name, contact details or payment information.
- Scrape, harvest or copy content, trip data, operator information or bid figures by automated means.
- Interfere with the site through automated submissions, denial of service attempts, vulnerability probing or any attempt to reach parts of the system that are not public.
- Solicit operators off platform to avoid the success fee after finding them here, or use rider contact details for marketing unrelated to a booking.
- Submit unlawful, threatening, defamatory or discriminatory content through any form on this site.
- Misrepresent a trip in a way that materially changes what an operator is being asked to price.
We may suspend or refuse access to anyone who breaks these rules, and we may report unlawful activity to the appropriate authorities.
10. Content You Submit
You keep ownership of what you write in a trip request, a message or, once the ratings system is live, a review. By submitting it you give us permission to use that content for the purpose it was submitted for: distributing your trip to operators, answering your message, operating and improving the platform, and publishing reviews in de-identified or first name form. You confirm that you have the right to submit it and that it is accurate.
We may remove content that breaches these terms, that is unlawful, or that identifies a third party who has not consented to being named.
11. Intellectual Property
The design, layout, written content, photographs, logo, name and software of this site belong to Best Limos of Myrtle Beach or to the parties who licensed them to us, and they are protected by copyright, trademark and other laws. You may read the site, print pages for your own use, and link to it.
You may not republish our written content, copy substantial parts of it into another site, use our name or logo in a way that suggests endorsement or affiliation, or present the marketplace as your own service. Operator names, vehicle photographs and marks belong to those operators and are used with their permission for bidding purposes only.
12. Disclaimer of Warranties
The site and the marketplace are provided on an as is and as available basis. To the fullest extent the law allows, we disclaim all warranties, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, title and non infringement.
We do not warrant that the site will be uninterrupted, error free or secure against every threat, that bids will be received for any given trip, that information supplied by operators is accurate, or that any operator will perform a booking to your satisfaction. Drive times, capacity guidance, seasonal advice and planning notes published across this site are estimates offered in good faith from practical experience. They are not promises, and traffic, weather, aircraft schedules and vehicle availability will do what they do regardless of what a web page says.
13. Limitation of Liability
To the fullest extent permitted by South Carolina and federal law, Best Limos of Myrtle Beach and its owners, staff and contractors are not liable for any indirect, incidental, special, consequential, punitive or exemplary damages arising from your use of this site or from any transportation arranged through it. That includes missed flights, missed sailings, missed ceremonies, missed tee times, lost profits, lost bookings, lost data and loss of enjoyment.
We are not liable for the acts or omissions of any operator, chauffeur or other third party, including late arrival, non arrival, unsafe driving, vehicle condition, property damage, personal injury or any dispute over a fare. Those claims lie against the carrier, which is why the carrier is required to hold insurance.
Where liability cannot be excluded, our total liability to you for any claim connected with this site or a booking made through it is limited to the amount of any fees you paid us in connection with that booking, which for riders is currently zero. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Best Limos of Myrtle Beach, its owners, staff and contractors against any claim, loss, liability, damage, cost or expense, including reasonable legal fees, arising out of your use of the site, your breach of these terms, your violation of any law or third party right, information you submitted that turned out to be false, or any dispute between you and an operator. We may take over the defence of any such claim at our own expense, and you agree to cooperate if we do.
15. Disputes and Governing Law
Start with the operator. Most problems with a trip are between you and the company you booked, and most of those are resolved by raising them promptly and in writing with that company. Tell us as well through the message form, because we track operator behaviour and can remove companies from the network, though we cannot adjudicate your contract with them.
For any dispute involving us, these terms and any claim arising from them are governed by the laws of the State of South Carolina and applicable federal law of the United States, without regard to conflict of law principles. You agree that the state and federal courts serving Horry County, South Carolina have exclusive jurisdiction, and you waive any objection to venue there. Before filing anything, both sides agree to spend thirty days trying to settle the matter informally through the contact form. Claims must be brought within one year of the event giving rise to them, to the extent the law allows a limit of that kind.
16. Changes, Severability and Reaching Us
We may revise these terms as the platform develops, most obviously when the booking, payment and ratings systems move out of the current build. The date at the top of this page changes when they do, and material changes are flagged on the site rather than slipped in quietly. Continuing to use the marketplace after a revision means you accept the revised terms.
If any part of this agreement is held unenforceable, that part is limited or removed and the rest stays in force. Our failure to act on a breach is not a waiver of the right to act later. These terms, together with the privacy policy, form the whole agreement between you and us regarding this site, and they replace anything said or written before.
